What is DSEAR?

The Dangerous Substances and Explosive Atmospheres Regulations 2002 (DSEAR) require employers to assess and then remove or control the risks from substances that can catch fire or explode. That covers flammable liquids and gases, combustible dusts, and the explosive atmospheres they can create. Where such an atmosphere can form, DSEAR also requires hazardous area classification (ATEX zoning), and equipment rated safe to use inside those zones.

Who needs a DSEAR assessment?

You have DSEAR duties if any of these are true at your site.

You store or handle flammable liquids or gases, such as diesel, LPG, solvents, or acetone.
You hold highly flammable liquids in any meaningful quantity.
You generate or handle combustible dusts, such as flour, sugar, wood dust, metal powders, or plastics.
A flammable atmosphere could form during normal work, cleaning, or a foreseeable fault.
The duty exists even when your controls are already good. Having the substances on site is what creates the legal duty to assess the risk. How good your controls are decides how urgent any gaps are, not whether the duty applies.

When should you review your DSEAR assessment?

On a schedule

Every three to five years as standard, or every one to two years on higher-risk sites.

On a change

Straight away after a process change, or a new or modified facility.

On an event

After a near-miss or enforcement notice, or when an inspection or insurance renewal is coming up.
